Abstract
Legislativa má vliv na podobu měst, jejichž nedílnou součástí jsou i veřejná prostranství. Přestože jsou veřejná prostranství obecně známým pojmem, jejich definice je z hlediska české legislativy problematická. Článek rozebírá veřejné prostranství optikou platné české legislativy a upozorňuje na její rozpor s výkladem veřejného prostranství ve stavebním zákoně a zákoně o obcích. Ilustruje její výklad na příkladu urbanistických struktur města Brna a zamýšlí se nad jejími slabinami.
Legislation has an impact on the shape of cities, which of course include public spaces. Although public space is a generally known term, its definition is problematic in terms of Czech legislation. This article analyzes public space through the lens of Czech legislation and draws attention to its contradiction with another valid law. This article illustrates the interpretation of legislation, using the urban structure of the city of Brno as an example. This article will also speculate about its weaknesses.
